Terms and Conditions

Welcome to D Nation Motorsports!

These Terms and Conditions (“Agreement”) govern participation in services, events, ride-alongs, lessons, rentals, media activities, and any other services provided by DNation Motorsports, Inc. (“Company,” “we,” “us,” or “our”).

By booking, participating in, attending, or using our services, you (“Participant,” “Customer,” or “Client”) agree to the following terms:

1. ASSUMPTION OF RISK

Participant understands and acknowledges that drifting, motorsports, ride-alongs, vehicle demonstrations, and related activities are inherently dangerous activities involving risks including but not limited to:

• Vehicle collisions

• Loss of vehicle control

• Mechanical failure

• Serious bodily injury

• Permanent disability

• Death

• Property damage

Participant voluntarily assumes all known and unknown risks associated with participation.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, Participant releases and holds harmless:

• DNation Motorsports, Inc.

• Vehicle owners

• Drivers

• Employees

• Contractors

• Sponsors

• Event organizers

• Track owners/operators

...from any and all claims, liabilities, damages, injuries, losses, or expenses arising from participation in any activity.

This includes claims resulting from ordinary negligence.

3. PARTICIPANT REQUIREMENTS

Participants must:

• Be at least 18 years old OR have signed parental/guardian consent

• Follow all safety instructions

• Wear required safety equipment

• Remain seated and restrained at all times

• Not interfere with vehicle operation

• Not be under the influence of drugs or alcohol

The Company reserves the right to deny participation for unsafe behavior.

4. VEHICLE AND EVENT CONDITIONS

Participant understands:

• Vehicles used for drifting may be modified performance vehicles

• Mechanical issues may occur without warning

• Events may be delayed, canceled, or modified due to:

  • Weather

  • Track conditions

  • Mechanical problems

  • Safety concerns

No guarantees are made regarding event duration or conditions.

5. PAYMENT AND REFUND POLICY

• Full payment may be required before participation.

• Deposits are non-refundable unless otherwise stated.

• No refunds for:

  • Late arrival

  • Failure to follow rules

  • Removal for unsafe behavior

  • Voluntary withdrawal

  • Weather

  • Track conditions

  • Mechanical problems

  • Safety concerns

The Company may issue reschedules or credits at its discretion.

6. MEDIA RELEASE

Participant grants permission for the Company to use photographs, videos, recordings, or media captured during events for:

• Advertising

• Social media

• Promotional materials

• Sponsorship content

...without compensation unless otherwise agreed in writing.

7. DAMAGE RESPONSIBILITY

Participant agrees to be financially responsible for any intentional damage caused to:

• Vehicles

• Equipment

• Track property

• Safety barriers

• Facilities

Normal motorsport wear and tear excluded.

8. NO GUARANTEE OF RESULTS

The Company makes no guarantees regarding:

• Driving skill improvement

• Competition outcomes

• Sponsorship opportunities

• Vehicle performance

9. INDEMNIFICATION

Participant agrees to indemnify and defend the Company against claims arising from:

• Participant actions

• Rule violations

• Negligence

• Injury caused to others

10. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Colorado.

Any disputes shall be handled in the appropriate courts within that state.

11. SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

12. ACKNOWLEDGMENT

Participant confirms they:

• Have read and understood these Terms and Conditions

• Understand the risks involved

• Voluntarily agree to participate
